GUEST WAIVER, RELEASE,
INDEMNIFICATION, & HOLD HARMLESS AGREEMENT

Thank you for choosing to
stay with Team SNW L.L.C. and TJRVJM Real Estate LLC (collectively “TJ’s
Destination Oshkosh”). In order to
occupy the Premises, we require that you accept this Guest Release, Waiver,
Indemnification & Hold Harmless Agreement, on behalf of yourself and any
others occupying the Premises with you, which is effective as of the date when
you first book or occupy the Premises, whichever happens first.

You (undersigned) represent
that you are 18 years of age or older. If you are bringing a minor(s) as a guest, you
acknowledge and agree that you are solely responsible for the supervision of
that minor(s) throughout the duration of your occupancy, and have read this Guest
Release, Waiver, Indemnification & Hold Harmless Agreement and agree to it
on the minor’s behalf. If you are
booking on behalf of other guests, you will ensure, and you represent and
warrant, that each guest on whose behalf you book has read and agreed to this Guest
Release, Waiver, Indemnification & Hold Harmless Agreement, which shall
apply to each of them as if the reference to "you" was a reference to
him/her.

You are aware and acknowledge that your
occupancy may involve certain inherent risks, dangers and hazards that include
but are not limited to sickness, property damage, serious personal injury,
physical distress, disability and death.

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, YOU
KNOWINGLY, VOLUNTARILY AND FREELY ASSUME ALL RISKS, BOTH KNOWN AND UNKNOWN, OF OCCUPANCY,
EVEN IF THOSE RISKS ARISE FROM THE NEGLIGENCE OR CARELESSNESS OF TJ’S
DESITINATION OSHKOSH OR OTHERS, OR DEFECTS IN THE PREMISES USED DURING YOUR
OCCUPANCY, OR OTHERWISE, AND YOU ASSUME FULL RESPONSIBILITY FOR OCCUPANCY.

You hereby release, waive liability, indemnify,
hold harmless, discharge and covenant not to sue TJ’s Destination Oshkosh and/or
the owner of the Premises, its members, officers, agents or affiliates from any
and all liability, claims, demands, actions and causes of action whatsoever
arising out of or related to any loss, damage, injury including death, that may
be sustained by me or others on the Premises, whether caused by negligence of TJ’s
Destination Oshkosh and/or the owner of the Premises, or its affiliates, or
otherwise, while in, on or upon the Premises.

You understand and competently agree
under my own free will that TJ’s Destination Oshkosh and/or the owner of the
Premises and its affiliates will not be responsible for any medical costs,
court costs and or attorneys’ fees associated with an injury, physical distress
or death you may sustain.

You also understand TJ’s Destination
Oshkosh and/or the owner of the Premises and its affiliates will not be
responsible for any damaged goods, including but not limited to equipment,
personal property, and vehicles in or on the Premises.

You understand that you will be held
responsible for any damage to equipment and or property you cause on the Premises. This includes damage caused by negligence.

In signing this Agreement, you
acknowledge and represent that you have read the foregoing Guest
Release, Waiver, Indemnification & Hold Harmless Agreement, understand it and sign it voluntarily.

You certify that you are fully competent
and you execute this Guest Release, Waiver, Indemnification &
Hold Harmless Agreement for full,
adequate and complete consideration fully intending to be bound by the same.
